Heard Sri T.M. Khan, learned counsel for the applicant and Sri Ashish Pandey, learned A.G.A. for the State.
The first bail application of the applicant was rejected by this Court vide order dated 28.4.2015, hence this second bail application has been moved on behalf of the applicant.
The new ground which has been argued by the learned counsel for the applicant is that the trial has not been concluded. Moreover, on the date and time of the incident, the applicant was not present in India as he was employed at Saudi Arabia, hence the applicant may be released on bail, who is in jail since 20.10.2014.
Learned A.G.A. has vehemently opposed the prayer for bail and has submitted that the trial is in progress.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Yasin involved in Case Crime No. 452 of 2014 under Section 498-A, 302, 120-B I.P.C., 3/4 D.P. Act, police station Nebua Naurangiya, District Kushinagar.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within a further period of six months from the date of production of a certified copy of this order.
