Heard Ms. Nandini Mishra, Advocate holding brief of Sri Ashish Kumar Pandey, learned counsel for the petitioner and perused the record.
Present petition has been filed by the petitioner seeking a direction to the Civil Judge(Junior Division) Shajganj, Jaunpur to decide the Original Suit No.804 of 2009(Ramashankar vs. Yashwant and others) expeditiously, within a stipulated time period.
It is submitted by the learned counsel for petitioner that the Original Suit is pending since year 2009 and could not be proceeded due to delaying tactics adopted by the respondent and only prayer is to direct the Court concerned for expeditious disposal of the same.
Without going into merit of the case, it is appropriate that the above Original Suit be decided expeditiously.
In view of above, the Civil Judge(J.D.)/Court concerned, Shajganj, Jaunpur is directed to decide the Original Suit No.804 of 2009(Ramashankar vs. Yashwant and others) expeditiously, preferably within one year from the date of production of certified copy of this order without granting adjournment unnecessarily to either of the parties, unless there is any legal impediment.
With aforesaid direction, the instant petition is finally disposed of.
