Yashwant Ram vs State Of U P And Others

High Court Of Judicature at Allahabad|21 December, 2018
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 48583 of 2003 Petitioner :- Yashwant Ram Respondent :- State Of U.P. And Others Counsel for Petitioner :- B.K. Tripathi Counsel for Respondent :- C.S.C.,B.D. Pandey,Jitendra Ojha,V.K. Singh Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
"(i) issue a writ, order in the nature of certiorari quashing the disputed appointment of respondent no.6 on the post of Shiksha Mitra, Semara Maharaj I, alleged made and formulated by the selection list dated 21.6.2003 on the basis of disputed resolution dated 3.12.02 of Gram Panchyat Semra Maharaj, Block-Farenda, District- Maharajganj.
(ii) issue a writ, order in the nature of certiorari quashing the entire disputed and collusive selection process in respect of appointment of Shiksha Mitra for the primary Institution of Semra Maharaj I, for the larger interest of candidates so that the justice may be done.
(iii) issue a writ, order/direction in the nature of suitable mandamus directing the respondents to consider the candidature of the petitioner on the basis of merit list of May 2002 for the selection on the post of Shiksha Mitra, Semra Maharaj Ist, of the primary Institution in the light of direction of this Hon'ble Court in accordance with law in the interest of justice."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
