Heard Sri Sunil Kumar Tiwari, learned counsel for the applicant and learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the only role assigned to the applicant is of catching hold the victim who was a pregnant lady whereas co-accused, Vikas is stated to have given blows by his leg on her abdomen, on account of which her child aborted and she sustained internal injuries. Therefore, the applicant may also be released on anticipatory bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation and the fact that the applicant and his associate have acted in a most cruel manner and learned A.G.A. has stated that prosecution version is supported by the medical evidence, I find no good ground for grant of bail to the applicant,Yashpal involved in Case Crime No. 365 of 2019 under Sections 323, 315 and 504 I.P.C., Police Station Mawana, District Meerut.
Accordingly, the anticipatory bail application is rejected.
