Heard learned counsel for the petitioner.
Petitioner has approached this Court seeking a mandamus to direct the respondents no. 2 to 3 to remove the illegal encroachment made by the respondents no. 4 to 6 over the petitioner's land.
Dispute is between two private persons in respect of the property. It is always open to the petitioner to seek such remedy as may be available to him under common civil law and a writ petition seeking mandamus to command the State respondents to take action in a dispute in respect of property between two private persons, is not liable to be entertained.
Writ petition, accordingly, stands dismissed leaving it open to the petitioner to take such other remedy as may be available to her in common civil law and if so advised.
