JUDGMENT / ORDER

1. The instant application is filed seeking temporary bail for four weeks in connection with Patdi Police Station, Surendranagar bearing I CR No.39/2010 pertaining to offences punishable under sections 465, 467, 468 etc. of IPC on the ground that the son of the accused - Yashinsha Motisha Fakir - is to marry on 14/06/2012.

Having considered the submissions advanced by Mr. A.A.Ansari, learned advocate for the applicant so also considering the submissions advanced by Mr. J.K.Shah, learned APP for the respondent - State and considering the marriage as well as communication of P.I., Vejalpur Police Station addressed to G.P. of this Court, upon preliminary investigation, the fact came to be ascertained that the marriage of the son of the accused is to be solemnised on 14/06/2012. However, Mr. J.K.Shah submitted that there are other family members in the family, who can take care of the marriage. However, there is no dispute that the son of the accused himself is going to marry. In that view of the matter, it would be in the interest of justice if the temporary bail for a limited period is granted on certain terms and conditions.
3. For the foregoing reasons, the application is partly allowed and the accused - Yashinsha Motisha Fakir is ordered to be released on temporary bail for a period of one week from the date of actual release on executing personal bond of Rs. 10,000/- with surety of like amount to the satisfaction of the concerned jail authority on the condition that during the period of his temporary bail, he shall maintain law and order and shall not take disadvantage of his liberty and on completion of the period of his temporary bail, he shall immediately surrender to concerned jail authority.
4. Direct service today, as prayed for, is permitted.
