Heard Sri Pushpendra Singh, learned counsel for the applicant, Sri Amir Khan, counsel for the informant and learned A.G.A for the State.
Learned counsel for the applicant submitted that the applicant is the husband of the victim with whom he had solemnized Nikah about two years back and allegations of ill-treating the prosecutrix and assaulting her and on account of assault launched by the applicant, pregnancy of his wife got aborted, are totally false.
Per contra counsel for the informant opposed the prayer for bail and submitted that the applicant has also solemnized marriage with another lady and has continuously tortured and ill-treated the prosecutrix, therefore, he is not entitled to be enlarged on anticipatory bail.
Taking into account of the allegation levelled against applicant and gravity of the crime, I am not inclined to grant the bail to the applicant.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicant Yaseen involved in Case Crime No. 0383 of 2019, u/s 498A, 377, 307, 313, 504, 506 IPC and 3/4 D.P. Act, P.S. Sikandrabad, District Bulandshahr.
Accordingly, the anticipatory bail application is rejected.
