Heard Sri J.B. Singh, learned counsel for the applicant and Sri Pankaj Saxena, learned A.G.A.-I appearing for the State- opposite party.
The present application under Section 482 Cr.P.C., has been filed seeking to direct the trial court to hear and decide the Session Trial No. 542 of 2014 (State vs. Aamir & others) arising out of Case Crime No. 525 of 2013, under Section- 147/302/34 IPC, Police Station- Lisari Gate, District- Meerut, expeditiously within a stipulated period.
Learned counsel for the applicant has placed reliance on the order sheet of the case, a copy whereof has been appended alongwith the affidavit filed in support of the application, to point out that although dates are being fixed for evidence since the year 2019, but for some reason or the other, the matter is being adjourned and the delay in disposal of the proceedings is causing undue hardship to the applicant. Accordingly, a prayer made in this application is to expedite the proceedings.
Learned A.G.A. for the State-opposite party has fairly stated that he has no objection, if the trial is expedited.
Having regard to the aforementioned facts and circumstances and without expressing any opinion on the merits of the case, the present application is disposed of with an observation that the court below would make an endeavour to decide the aforesaid case in accordance with law as expeditiously as possible, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
