JUDGMENT / ORDER

Thottathil B.Radhakrishnan, J. 1. As rightly pointed out by the learned counsel on either side, issues raised in this writ appeal are covered against the appellant as per judgment dated 03.09.2014 in W.A.No.941 of 2014 and connected cases. However, we are inclined to grant the same relief to the petitioner herein, as was granted as per that judgment of the Division Bench to the petitioners in the writ petitions which led to the writ appeals in which the judgment dated 03.09.2014 was delivered.
2. In the result, the judgment impugned is confirmed, however that the writ appeal is further ordered as follows:-
(i) The writ petitioner is permitted to make an application for waiver before the Station Manager/Goods Supervisor within 30 (thirty) days from today giving all details along WA 1714/14 -2-
with reasons and relevant records as necessary.
(ii) Station Master/Goods Supervisor shall forward the application for waiver of demurrage charges to the Divisional Officer with his remark within 15 (fifteen) days of receipt of the application.
(iii) The Divisional Officer shall take a decision on the waiver application considering the reasons and circumstances given by the writ petitioner in the waiver application. Consequential orders be issued thereafter. In case the writ petitioner is aggrieved by the said decision, it can prefer appeal to the higher authority.
