Heard learned counsel for the petitioner and Shri Sanjay Kumar Singh, learned Standing Counsel.
The petitioner is before this Court assailing the order dated 16.10.2018 passed by second respondent by which the stay application in the appeal in question has been rejected.
The Court has proceeded to examine the record in question and does not find any infirmity or illegality in the order impugned so as to make interference in the matter at this stage under Art.226 of the Constitution of India. However, in the interest of justice, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the appellate authority to decide the appeal in question in accordance with law expeditiously and preferably within two months from the date of production of certified copy of this order. Any third party interest, in the meanwhile, shall be subject to final decision of the appeal in question.
