Heard learned counsel for the applicant and learned A.G.A. for the State.
The submission is that the applicant is suffering from kidney failure and he is under treatment and undergoing dialysis.
Counsel for the applicant submits that he is not in a position to attend the date before the trial court easily and he may be permitted to appear through counsel.
This application is disposed of granting liberty to the applicant to make appropriate application before the court below and the court below is directed to consider and grant exemption to the applicant on the dates when his personal appearance is not required for the purpose of evidence, framing of charges etc.
Keeping in view of the medical condition, the applicant shall bring on record the documents regarding his medical treatment before the trial court which shall be considered by the trial court before passing appropriate order.
