HON’BLE Dr. JUSTICE K.G.SHANKAR Criminal Petition No.6113 of 2014 Order:
The petitioners seek for quashment of First Information Report (FIR) in Crime No.421 of 2013 on the file of Narayanguda Police Station, Hyderabad.
The petitioners are accused 1 and 2. They allegedly committed offences under Sections 420, 406, 468 and 471 read with Sections 120-B and 34 IPC.
2. There is heavy litigation between the 2nd respondent on the one side, who is the de facto complainant and the petitioners on the other side.
There are allegations and counter allegations by both sides. At this stage, it may not be appropriate to reach any conclusion on this issue; more so when the matters are pending before competent Civil Courts.
3. So far as the present case is concerned, in the light of the disputes between the petitioners on the one side and the 2nd respondent on the other side, I consider it appropriate to permit the Police to proceed with the investigation and try to find out the truth. At the same time, where it is contended by the petitioners that they are the owners of the disputed property, I deem it appropriate to direct the Police not to arrest the petitioners during the pendency of the investigation.
4. Accordingly, this criminal petition is disposed of permitting the Police to proceed with the investigation of the case in Crime No.421 of 2013 on the file of Narayanguda Police Station, Hyderabad, with a direction not to arrest the petitioners during the pendency of the investigation. The miscellaneous petitions, if any, pending in this petition shall stand closed.
