Yakubbhai vs State

The applicant has filed this application for joining as party respondent in Special Criminal Application No. 1491 of 2005 pending in this Court as an intervener on the apprehension that original petitioner of Special Criminal Application as above is not likely to contest the matter in true spirit.

The above apprehension is based on no material on record and this Court would not like to exercise the powers as prayed for on the basis of mere appreciation and likelihood of an event which may take place or may not take place.

The petition is misconceived and is rejected accordingly.
