When the matter is taken up for hearing, none appeared for the appellant on 28-02-2014, 28-03-2014, 11-04-2014 and on 13-06-2014, and hence, the matter is directed to be listed under the caption “for dismissal” on 20-06-2014. Even today also, when the matter is taken up for hearing, none appeared for the appellant even though the matter is posted under the caption “for dismissal”. It indicates that the appellant is not evincing any interest in pursuing the matter, and therefore, this court is left with no other option except to dismiss the appeal for default.
Accordingly, the Second Appeal is dismissed as non- prosecution. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
