Heard Sri Alok Kumar Yadav, learned counsel for the petitioner, learned A.G.A. for the State and Sri Mahendra Kumar Singh, learned counsel for the caveator-respondents.
The present petition has been filed for setting aside the order dated 07.09.2021 passed by learned Additional District and Sessions Judge, Court No.7, District Kaushambi as well as order dated 08.03.2021 passed by learned Sub-Divisional- Magistrate, Manjhanpur, District Kaushambi and also to direct the respondents not to dispossess the petitioner from the plot no. 1758.
It is provided under Section 146 (1) Cr.P.C. that the order passed under Section 145 (1) Cr.P.C. can be revoked at any time. The Counsel for both the parties have jointly prayed that they may move an appropriate application before the appropriate Court for revocation of the order and the Court below may be directed to decide the same.
In view of above, in case appropriate application is moved before the concerned Court below, appropriate order may be passed in accordance with law, preferably within a period of two months for revocation of the impugned order, under Section 146 Cr.P.C.
With the aforesaid observations, the instant petition is disposed off., Order Date :- 29.10.2021 S.Ali
