Petitioner was appointed as class IV employee in Lal Surya Pratap Purva Madhyamik Vidyalay Khoriya, Allahabad, who has attained the age of superannuation on 31.7.2013. It is stated that petitioner is entitled to payment of gratuity in terms of the Government Order dated 30.7.2007, but the amount due on this count has not been paid so far. Various representations are stated to have been made which have remained pending.
Sri A.K. Yadav, learned counsel appearing for the District Basic Education Officer, Allahabad submits that claim of the petitioner shall be considered in accordance with law.
In the facts and circumstances, this writ petition stands disposed of permitting the petitioner to approach respondent no.4 in respect of his grievance noticed above, alongwith certified copy of this order, within a period of two weeks from today. In case such a claim is raised, the same shall be considered by the respondent no.4, in accordance with law, by means of a reasoned order, within a further period of three months thereafter. In case any amount is found due and payable to petitioner towards gratuity, the same shall be released within a further period of six weeks thereafter.
