Heard learned counsel for the petitioner, Sri Atma Prakash Tripathi, learned counsel appearing for the Union of India and the learned Standing Counsel appearing for the State-respondents.
By means of this writ petition the petitioner has challenged the order dated 2.2.2018 by which the petitioner, who was a government employee and sent on deputation under the Government of India Scheme known as Agriculture Technical Management Agency, upon completion of five years under the said Agency, has been repatriated to his parent department, which is Agriculture Department under the State of Uttar Pradesh.
Learned counsel for the petitioner submits that the deputation of the petitioner under the aforesaid Scheme was till the continuation of Scheme and now after completion of five years, he has been repatriated to the parent department, which is against the Scheme itself.
It is to be noted that the petitioner is a government employee working in the Agriculture Department in the State of Uttar Pradesh and by virtue of Government Employee, he was engaged under the Scheme, now he has been sent back to his parent department. If the employees are being sent back to their parent department, it does not appear that any condition of service of the petitioner is being affected or his seniority in any way disturbed or any financial loss is occurred to the petitioner.
The petitioner, being a government employee, is repatriated to his parent department, which does not in any manner affect the right of the petitioner and as such, no interference is called for.
There is no merit in the writ petition. It is, accordingly, dismissed.
