Grievance of petitioner was noticed by this Court in previous order dated 02.12.2021, which is extracted hereinafter:-
"Contention is that petitioner was assigned work of soil testing by the respondents and the work in that regard was duly performed. It is submitted that only part of the amount has been released and remaining amount has unauthorizedly been kept pending, though the dues are admitted. Attention of the Court has been invited to a reply dated 5.10.2020.
Learned Standing Counsel may obtain instructions in the matter, by the next date fixed. Put up as fresh, once again, on 17.12.2021."
Learned Standing Counsel has obtained instructions from the Assistant Director, Soil Testing as per which bills submitted by petitioner have been processed and that no further claim in that regard is pending. Copy of instructions has been furnished to petitioner's counsel.
Counsel for petitioner points out that large number of other bills submitted in the same manner have not been examined by the authorities.
Without entering into merits of petitioner's claim we provide that petitioner shall furnish details of pending bills to the fourth respondent, who shall examine the same in terms of the contract and would take necessary decision in accordance with law, within a period of two months from the date of presentation of a certified copy of this order. Liberty stands reserved to petitioner to approach appropriate forum in the event any grievance survives, thereafter.
Writ petition is, accordingly, disposed off.
