ORDER:
Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents.
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the proceedings No.01/114(01)/2014- ELR, dated 20.06.2014 of the 2nd respondent placing the petitioner under suspension as illegal, arbitrary and in violation of principles of natural justice.
The petitioner who is the driver of the APSRTC was placed under suspension for the reason that he allowed a gas cylinder to be transported in the bus.
The version of the petitioner is that there is no conductor in the bus and he has to discharge the duties of driver as well as the conductor, and when he went to the reservation counter to verify the list of passengers, somebody placed the cylinder in the bus without his knowledge.
Having regard to the nature of the allegations levelled against the petitioner, the respondents are directed to complete the enquiry after following due procedure against the petitioner within a period 6 (six) weeks from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. In the circumstances there shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in consequence.
