RESPONDENTS ORDER:
This Criminal Petition is filed to quash the F.I.R in Crime No.147 of 2012 dated 15.02.2012 of Banjara Hills Police Station, Hyderabad.
Heard both sides.
Learned counsel for the petitioners submitted that A.1 to A.3 initiated some Criminal cases and Civil Suit against the de facto complainant and as a counter blast present complaint is given without any material. It is submitted that A.2 filed cheque bounce case and the same is pending trial before the Special Metropolitan Magistrate at Hayathnagar.
Learned Additional Public Prosecutor submitted that police after completion of investigation filed final report stating that there is no evidence and closed the case on the ground of lack of evidence, he produced the report of the Additional Inspector of Police, Banjara Hills Police Station dated 5.12.2013, according to which the Additional Inspector of Police obtained opinion from the Senior APPO and on that final report was submitted to the Court concerned to treat the case as lack of evidence.
Since the final report is already filed treating the case as lack of evidence, the criminal petition becomes infructuous. Therefore Criminal Petition is dismissed as infructuous.
