This petition is coming on for admission this day, the Court made the following:-
ORDER Service of notice to respondent No.2 is dispensed with since no adverse order is passed so as to affect his right.
2. Petitioner has questioned the validity of proceedings pursuant to CC No.958/2010 on the file of the learned JMFC-II, Mysuru District registered for the offences punishable under Sections 448, 323, 504, 506 read with Section 34 of IPC.
3. Learned counsel for the petitioner submitted that matter is in progress at the stage of adducing evidence. Therefore, petitioner is not insisting with reference to the relief sought for in the present petition. On the other hand, request is for expedite the matter by the Court below. Having regard to the fact that matter has reached the stage of evidence and petitioner and complainant – 2nd respondent are aged about 61 and 78 years old respectively, Court below is requested to make necessary endeavour to decide the matter pertaining to C.C.No.958/2018 on the file of JMFC-II, Mysuru District registered for the offences punishable under Sections 448, 323, 504, 506 of IPC within a reasonable period of six months from the date of receipt of this order.
With the above observations, petition stands disposed of.
