HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 31518 of 2014 ORDER:
Petitioner claims that he is owner of land to an extent of Ac. 12.25 cents in Survey No. 189/2, Pallur village, Kambadur mandal, Anantapur district . It is his case that earlier wrong declaration was given by another person showing his land as surplus land, however on complaint given by the petitioner, the declarant has agreed that he has given a wrong declaration and accordingly appropriate orders are passed by the Land Revenue Tribunal on 12.9.1996 restoring the land to the petitioner. Certificate of delivery of possession of re-transferred land was issued in Form XI-A by the Tahsildar, Kambadur on 2.7.2012. Petitioner is in possession of the said land. Petitioner intend to dispose of the said land and approached the Sub Registar-5th respondent for valuation of the property. The Sub Registrar refused to furnish the same on the ground that subject land is classified as ‘assigned land’. However, there is no material to show that petitioner has presented the deed of conveyance which is not accepted by the Sub Registrar.

Having regard to the same, writ petition is disposed of giving liberty to the petitioner to present the deed of conveyance and as and when such a deed of conveyance is presented, the Sub Registrar-5th respondent shall receive and process the same in accordance with Registration Act, 1908, and the Indian Stamp Act, 1899, duly taking note of the orders passed by the Land Reforms Tribunal granting possession to petitioner. Consequently, if Sub Registrar-5th respondent has any other objection regarding registration, he shall pass orders assigning the reasons for such refusal and communicate the same to the petitioner in accordance with Section 71 of the Registration Act, 1908. The above exercise shall be completed within three weeks from the date of presentation of document. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
