Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the order passed by the first respondent in G.O.Ms.No.307, School Education Department dated 15.12.2000 in so far as cut off date by way of prospective effect implementation imposed and the consequential order passed by the second respondent in his proceedings P.12/11/K92-960/AR/04-05/ADK/730 dated 08.11.2004 and quash the same and direct the respondents to sanction pension and other terminal benefits to the petitioner accordingly.
For Petitioner : Mr.C.Vediappan For Respondent Nos.1, 3 & 4 : Mrs. K.Bhuvaneswari Government Advocate For Respondent No.2 : Mr.T.S.Selvarani O R D E R The petitioner filed a writ petition to call for the records pertaining to the order passed by the first respondent in G.O.Ms.No.307, School Education Department dated 15.12.2000 in so far as cut off date by way of prospective effect implementation imposed and the consequential order passed by the second respondent in his proceedings P.12/11/K92-960/AR/04-05/ADK/730 dated 08.11.2004 and quash the same and direct the respondents to sanction pension and other terminal benefits to the petitioner accordingly.
2. The second respondent has filed the counter. The relevant portion of the counter i.e., paragraph No.2 in page No.2 reads as follows:
"It is submitted that at the outset that the pensionary benefits of the petitioner have been revised and necessary authorisation for the payment of the same were issued on 30.03.2007, by this respondent, meeting fully the claim of the petitioner as preferred through this Writ Petition".
In view of the above, since the claim of the petitioner has already been settled in favour of the petitioner, this court do not find that anything would survive for adjudication in the writ petition. Hence, the writ petition is dismissed. No costs.
