Writ Petition No.2557 Of 2017 vs The Tahsildar

Madras High Court|02 February, 2017

JUDGMENT / ORDER

The petitioner has come up with this Writ Petition seeking a direction to the 1st respondent to issue patta in her name after receipt of Survey Report from the 2nd respondent for the property situated at No.38, Sirucherry Village, Tiruporur District.
2. According to the petitioner, she is in possession and enjoyment of the property in question. It is her grievance that though she sent a representation to the respondents on 16.08.2016 seeking to survey the lands in question and issue patta to her, there is no response from them. Hence, she is before this Court with the above Writ Petition.
3. Heard the learned counsel on either side and perused the material documents available on record.
4. On a perusal of the material records, it is seen that the petitioner has only sent a representation seeking patta and not an application in the prescribed form. First of all, the petitioner has to apply for patta by paying necessary challan fee of Rs.5/- in the office of the Tahsildar. Without doing so, she has straightaway approached this Court seeking a writ of mandamus. Such petitions cannot be entertained. Hence, the petitioner is directed to apply to the respondents seeking issuance of patta, in the prescribed form by paying requisite challan fee and if no orders are passed on it within three months, then she is at liberty to approach this Court seeking a direction to consider her representation.
This Writ Petition is dismissed with the above direction. No costs. Consequently, connected W.M.P.No.2562 of 2017 is closed.
