Writ Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Certiorarified mandamus calling for records of the Central Administrative Tribunal, Madras Bench relating to the order dated 29th of August 2012 passed in Original Application No.276 of 2011, and quash the same and direct the respondents to grant the benefits of the Assured Career Progression Scheme (ACP) to the petitioner from the date of joining service and grant all related benefits from that date.
The learned Senior Counsel for the petitioners submitted that, during the currency of these Writ Petitions, the respondents filed Review Applications before the Tribunal. The Review Applications were allowed by the Tribunal. In short, the orders, dated 29.08.2012, were set aside by the Tribunal, by order, dated 19th September of 2016. In view of the same, nothing survives for adjudication. The learned Senior Counsel, therefore, seeks liberty to challenge the order, dated 19 September, 2016, in Review Application Nos.27 to 48 of 2015.
2. Since the Review Applications were allowed, pending disposal of these Writ Petitions, it is open to the petitioners to challenge the subsequent order, dated 19.09.2016, if they are so advised.
3. We dismiss the Writ Petitions with liberty. No costs. Consequently, connected Miscellaneous Petitions are closed.
