JUDGMENT / ORDER

The writ petition has been filed to forbear the respondents, their sub-ordinates from interfering with the activities of the petitioner's club including playing cards like rummy without stakes and also from harassing the members, guests and the staff of the club in any manner.

According to the petitioner, it is a registered club offering facilities to its members through in-door games such as table tennis, carrom board, chess, billiards, playing cards for recreation purpose and out door games such as tennis, cricket, shuttle badminton, volley ball, etc., According to them, the club has facilities for its members and their guests to play 13 cards rummy without stakes and it did not permit them to play 13 cards rummy with stakes, which would amount to gambling. According to the petitioner, the respondent police are harassing by riding them unnecessarily. Further they are running the club in lawful manner and no money is involved in playing cards by members. They also made a representation dated 24.06.2016 to the first respondent seeking direction to respondents 2 to 4 not to interfere with day to day affairs of the club but no action has been taken by the respondents. Hence, the present writ petition is filed.

Counter has been filed by the fourth respondent stating that they never harassed the petitioner club and that they are conducting periodical inspection and if money is utilised in playing card or any such complaint is received, the police reserves their right to inspect at regular intervals and to take legal action.
4.Heard both sides.
5.Since the petitioner has stated that they are not allowing members to play rummy with any stakes, this court now imposes further conditions for playing cards that it shall not be in the form of cash for playing cards with cash or any form of chip or token or card or by any other means, money should not be involved after the game is over and that it shall not be in any other form collecting as table money for playing cards or in the form of knock out basis for 320 points, any amount fixed or in the form of three cards by collecting money, after the game is over. When such actions are involved or found out or if any such complaint is received by the police, the B.RAJENDRAN,J.
vri police is at liberty to ride and arrest the persons in the club. It is also made clear that when the police issued license, they are also eligible to impose any other reasonable conditions without affecting their right to conduct the club. The writ petition is disposed of accordingly. No costs. The connected miscellaneous petition is closed.
