JUDGMENT / ORDER

Mr.M.Maharaja, learned Special Government Pleader takes notice for the respondents. By consent, the writ petition is taken up for disposal in the admission stage itself.
2.The petitioner has filed the above Writ Petition to issue a writ of certiorarified mandamus calling for the records pertaining to the letter dated 03.07.2017 addressed to the petitioner by the 2nd respondent rejecting the request of petitioner to perform Abhishekam to Urchavar at Arulmighu Parimala Ranganathar Temple and to quash the same and consequently, direct the 2nd respondent to permit the petitioner to conduct Abhishekam and Tirumanjanam to the Urchavar in Arulmighu Parimala Ranganathar Temple, Tiruindaloor, Mayiladuthurai.
3.The Executive Officer, by his letter dated 03.07.2017, rejected the request of the petitioner for performing Abishekam to the Urchavar.
3.Mr.V.Subramanian, the learned counsel appearing for the petitioner submitted that when the respondents have given permission to Mohanakrishnan, to do Abishekam and other worships to the deity, the petitioner should also be given permission for conducting poojas.
4.Mr.M.Maharaja, learned Special Government Pleader appearing for the respondents submitted that under Section 63(e) of the Hindu Religious and Charitable Endowments Act, it is only the Joint Commissioner of the Hindu Religious and Charitable Endowments Department, who should decide the request of the petitioner.
5.Since the petitioner has approached the 2nd respondent for getting permission, I am of the view that the petitioner can be given liberty to give fresh representation to the Joint Commissioner of the Hindu Religious and Charitable Endowments Department seeking for permission. In such view of the matter, I give liberty to the petitioner to give fresh representation to the Joint Commissioner of the Hindu Religious and Charitable Endowments Department within two days from the date of receipt of a copy of this order and on receipt of the same, the Joint Commissioner of the Hindu Religious and Charitable Endowments Department is directed to decide on merits and in accordance with law within four days from the date of receipt of a fresh representation from the petitioner.
6.With these observations, the Writ Petition is disposed of. No costs.
