The petitioner has preferred Ext.P4 application before the 1st respondent, seeking an exclusion of his land comprising of 4.53 Ares of land (11.20 cents) in Survey No.747/p of Ollukkara Village, Thrissur District, from the Land Data Bank prepared for the region. The limited prayer of the petitioner is for a direction to the 1st respondent to consider and pass orders on Ext.P4 application preferred by the petitioner, expeditiously, after hearing him.
2. I have heard the learned counsel for the petitioner as also the learned Government Pleader for the respondents.
3. On a consideration of the facts and circumstances of the case as also the submissions made across the Bar, I dispose the writ petition with a direction to the 1st respondent to consider and pass orders on Ext.P4 application, preferred by the petitioner, within a period of three months from the date of receipt of a copy of this judgment, after hearing the petitioner. The petitioner shall produce a copy of the writ petition along with a copy of this -2- W.P.(C) No.231 of 2018 judgment, before the 1st respondent, for further action.
It is made clear that further proceedings, based on Ext.P3 notice, shall be subject to the outcome of the decision of the 1st respondent on Ext.P4 application.
