The petitioner, currently an Assistant Professor under the Kerala Agricultural University working at KCAET, Thavannur, who has been ordered to be posted at Regional Agricultural Station, Kumarakom, impugns the order of transfer alleging violation of the norms as well as loss of chance of promotion avenues. This Court cannot normally interfere with the transfer unless it violates any norms of transfer or it would violate service conditions of such employees. The petitioner in this writ petition highlights the norms and submits that there are other seniors and juniors who have not moved out from this station (Thavannur) and the petitioner has been singled out for transfer to Kumarakom and therefore, it would violate the transfer norms as referred under the guidelines (7). Apart from that the petitioner has a case WPC 19309/2018 -:2:- that he would be adversely be affected of further promotion for career advancement in accordance with the UGC Regulation for the single reason that at Kumarakom there is no scope for gaining teaching experience. In this regard, it is appropriate to refer paras.(vii) and (viii) of the reply affidavit filed by the petitioner on 5.7.2018, which reads as follows:
(vii) As per the norms prescribed by the UGC 75 API score is awarded to the teaching experience and 40 API score is awarded to the research experience. If a particular teacher is not earning 115 API points in a year he will not be considered for further promotion for career advancement. It is therefore submitted that the impugned transfer order also adversely affects the future promotion prospects of the petitioner.
