Mr. R.K. Gandhi, learned Standing Counsel, accepts notice for the respondent. With consent, this writ petition is taken up for final disposal at the admission stage itself.
2 Though this writ petition has been preferred seeking the following relief:
a writ of mandamus directing the respondent to settle the terminal benefits of the petitioner, surrender of earned leave of 226 days amount of Rs.2,56,133/- and gratuity, pension and leave salary by revising the petitioner's basic pay, grade pay, dearness allowance, increment benefits 10% dearness allowance and 5th review benefits with consequential benefits as per wage settlement with interest at the rate of 6% per annum by considering his representation dated 24.02.2017. T. RAJA, J.
cad it is the admitted claim of the petitioner that all the retirement/pensionary benefits, except leave salary and 5th review benefits, have been settled and in respect of release of the same, he has addressed a representation dated 24.02.2017 to the respondent, which is still consideration and hence, it would suffice if a direction is given to the respondent to consider and pass orders on the said representation dated 24.02.2017.
3 Given the limited scope of the relief sought by the petitioner, without going into the merits of the case, this Court directs the respondent to consider and pass orders on the petitioner's representation dated 24.02.2017 on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
The writ petition stands disposed of with the above direction. Costs made easy.
