JUDGMENT / ORDER

Learned counsel for the petitioner submitted that merely on the basis of ex-parte report and the future use of land, the agricultural land has been treated as residential land by the A.D.M. (Finance & Revenue), Ghaziabad. In appeal, the Board of Revenue has dismissed the appeal and has illegally directed for further inquiry, which is patently illegal.
Learned Standing Counsel prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Till the next date of listing, the realization of demand shall remain stayed provided the petitioner deposits 50% of the demand towards deficient stamp duty within 30 days. Any amount already deposited shall be given adjustment.
