Prathima Honnapur, AGA) …Respondent This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to call for records in arbitration suit No.66/2015 on the files of City Civil Judge (CCH No.83) and issue a writ of mandamus or any other appropriate writ or command or any other order or direction to the City Civil Judge, Bengaluru (CCH No.83) to expedite the disposal of the arbitration suit No.66/2015 (Annexure-B) within a time frame of three months.
This Writ Petition coming on for Preliminary Hearing, this day, the Court made the following:-
ORDER Smt.Yovini Rajesh, learned counsel for Sri.Rajesh Chander Kumar, learned counsel for the petitioner.
Smt.Prathima Honnapura, learned Additional Government Advocate for the respondent.
2. In this petition, the petitioner inter alia has prayed for a direction to the City Civil Judge, Bengaluru (CCH No.83) to expedite the disposal of the arbitration suit No.66/2015 (Annexure-B) within time frame of three months.
3. When the matter was taken up today, learned counsel for the petitioner submitted that award has been passed in favour of the petitioner on 12.10.2014 and the arbitration suit is pending before the trial Court since 2015. However, no effective steps have been taken to conclude the proceedings.
4. In view of the aforesaid submission and in the facts of the case, the writ petition is disposed of with a direction to the trial Court to conclude the proceedings preferably within a period of four months from today.
Accordingly, the writ petition is disposed of.
