Leave to amend. The petitioner - original claimant in Motor Accident Claim Petition No. 928 of l993, pending before Accident Claim Petition No. 929 of l993, pending before this application for transferring the said petition to the Motor Accidents Claims Tribunal, Ahmedabad City. Rule has been issued in this matter, which has been served on the respondents. However, no appearance has been filed on behalf of the respondents, nor any reply has been filed by the respondents contesting the application. Heard the learned Advocate for the petitioner.
2.From the averments made in the application, I am satisfied that the petitioner has made out a case for transfer of MAC Petition No. 929 of 1993 from the MAC Tribunal, Junagadh to the MAC Tribunal, Ahmedabad City. Such transfer is now permissible under S.l66(2) of the Motor Vehicles Act, 1988, and no prejudice is likely to be caused to the respondents by such transfer.
3.Hence this Misc.Civil Application is allowed. MAC Petition No. 929 of 1993 pending before the MAC Tribunal, Junagadh is ordered to be transferred alongwith the record and proceedings to the MAC Tribunal, Ahmedabad City. Rule is made absolute with no order as to costs.
