The petitioner - original claimant in Motor Accident Claim Petition No. 159 of l995, pending before the Motor Accidents Claims Tribunal (Main), Surendranagar,has filed this application for transferring the said petition to the Motor Accidents Claims Tribunal, Kheda, at Nadiad. Rule has been issued in this matter, which has been served on the respondents. However, no appearance has been filed on behalf of the respondents, nor any reply has been filed by the respondents contesting the application. Heard the learned Advocate for the petitioner. 2.From the averments made in the application, I am satisfied that the petitioner has made out a case for transfer of MACP No. 159 of 1995 from the MAC Tribunal (Main), Surendranagar to the MAC Tribunal, Kheda at Nadiad. Such transfer is now permissible under S.l66(2) of the Motor Vehicles Act, 1988, and no prejudice is likely to be caused to the respondents by such transfer.
3.Hence this Misc.Civil Application is allowed. MAC Petition No. 159 of 1995 pending before the MAC Tribunal (Main), Surendranagar is ordered to be transferred alongwith the record and proceedings to the MAC Tribunal, Kheda at Nadiad. Rule is made absolute with no order as to costs.
