In this petition under Article 227 of the Constitution of India, the petitioner has challenged the order passed by the Labour Court on 25.6.84, in Recovery Application No.1203/81, whereby the petitioner company has been directed to pay an amount of Rs.1578/- with cost of Rs.50/- under the provisions of section 33(C)(2) of the Industrial Disputes Act, 1947. At the time of issuing rule, this Court passed ad interim order against the execution of the award on the condition that the petitioner company shall deposit an amount of Rs.1628/- in this court, pursuant to which, the amount came to be deposited.
Having regard to the facts and circumstances emerging from the present case and considering the limited supervisory jurisdiction under Article 227 of the Constitution of India, this Court is not inclined to interfere with the impugned order. However, the amount deposited pursuant to the order of this Court is ordered to be paid to the respondent. In other words, it will be open for the respondent to withdraw the said amount of Rs.1628/-. Obviously, there would not arise any question of claiming interest on the said amount.
In the result, this petition is dismissed with no order as to costs. Rule discharged.
