Memo of appearance filed today by Sri Vijay Raj Pal, Advocate on behalf of respondent no.1 is taken on record.
Heard learned counsel for the parties and perused the record.
This writ petition has been filed, inter alia, for the following reliefs :-
"(i) Issue, a writ, order or direction in the nature of certiorari to quash the order dated 21.02.2019 passed on complaint of petitioner no.1 by respondent no.3 contained Annesure-8 to the writ petition.
(ii) Issue, a writ, order or direction in nature of mandmus directing/commanding the respondent no.2 to direct the respondent no.3 to pass a fresh order upon the petitioner's complaint within stipulated period."
From perusal of the impugned order dated 21.02.2019, passed by respondent no.3- Banking Lokpal, Reserve Bank of India, M.G. Road, Kanpur, it shows that the complaint filed by the petitioner before the concerned Bank is not in terms of Para 9 of Clause 3 of the Banking Ombudsman Scheme, 2006. It is also notable that respondent no.3 has sent the application of the petitioner to respondent no.5 for consideration for taking appropriate action in the matter and also advised the petitioner to approach the concerned bank for redressal of his grievance.
In view of the above, we do not see any illegality or infirmity in the impugned order dated 25.10.2018 passed by respondent no.3 - Banking Lokpal, Reserve Bank of India, M.G. Road, Kanpur. However, it is expected that the concerned Bank would decide the matter in accordance with law expeditiously.
It is made clear that this court has not expressed any opinion on the merits of the case and the concerned authority has to take decision on its own merits.
With the aforesaid observations, this petition is disposed of.
