The petitioner claims that it is an association, which looks after the interest of its members. Its grievance is that uninterrupted power supply for the residents of Noida city may be directed to be provided. It has preferred this writ petition under Article 226 of the Constitution, amongst others for the following reliefs:
"(a) Issue a writ, order or direction in the nature of mandamus directing the respondents not to charge 'fixed charges' of electricity and to follow the tariff order issued by U.P. Electricity Regulatory Commission Lucknow effective from 1.12.2004.
(b) Issue a writ, order or direction in the nature of mandamus directing the Electricity company distribution licensee to have underground cable system of supply and to supply the electricity 24 hours in the Noida city which is the most important and commercial city of Uttar Pradesh and is situated in district Gautam Budh Nagar.
(c) Issue a writ, order or direction in the nature of mandamus directing the U.P. Electricity Regulatory Commission Lucknow to take suitable action against the distribution licensee Paschimanchal Vidyut Vitran Nigam Limited, Victoria Park, Meerut for violating the rate schedule issued by Uttar Pradesh Electricity Regulatory Commission, Lucknow."
Sri Ranjeet Saxena, learned counsel for the petitioner has made a prayer that this Court may direct the respondent no.4 to consider the grievances of the petitioner at the first instances.
From the materials on record, we find that the petitioner has made several representations to the several authorities to ventilate its grievance but in vain. Taking into consideration the facts and circumstances of the case, we are of the view that the grievance of the petitioner needs to be addressed by the competent authority. Accordingly, to meet the ends of justice we issue a direction to the respondent no.4 to consider the grievance of the petitioner, by furnishing an opportunity, within two months from the date of receipt of a copy of this order.
Needless to say that we have not expressed our opinion on the merit of the case and the authority concerned shall pass an appropriate order independently in accordance with law.
With the aforesaid observation the writ petition is disposed of.
