This application u/s 482 Cr.P.C. has been filed for quashing the entire proceeding of S.T. No. 962/2015 arising out of case crime no. 152/2015, u/s 498A, 307, 323, 504, 506 IPC and 3/4 D.P. Act, P.S. Katghar, Distrit Moradabad pending before the A.D.J.-14, Moradabad.
Heard applicants' counsel and learned A.G.A. for the State. Record has been perused.
It is argued that during the pendency of the proceeding before the trial court the applicant (husband) and opposite party no. 2 have settled their disputes and are living together. In this behalf an application has been filed before the Addl. Session Judge, Court no. 4, Moradabad on 8.1.2018 for accepting the compromise.
In the facts and circumstances of the case, the court concerned is directed to pass appropriate order in accordance with law on the said application keeping in mind the settled proposition of law about the case in which parties have amicably settled their disputes, which are purely of private nature. The court is at liberty to quash the proceedings which include non compoundable offences.
With the aforesaid observation this application is disposed off.
