. Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein, the High Court will be pleased to issue a writ of mandamus or any other appropriate writ, order or direction;
a) By declaring the action of the respondents in not taking any concrete action against the accidents being caused by the RTC buses and lorries especially in cases where the victims are being crushed under their wheels as illegal and unconstitutional and also amounting to violation of human rights.
b) To direct the respondents to forthwith pass suitable orders or to come up with appropriate schemes for lowering the bodies of RTC buses and lorries to a height of one feet from the Road level and for providing crash guards and railings on all the sides of lorries at a height of 1 feet from Road level.
c) To direct the respondents to see that all glowing indicators and danger lights on the R.T.C.buses, lorries and autos are kept in working condition and used compulsorily.
d) To direct the respondents to see that no lorry carries steel Roads or other material, which projects or protrudes out of its body size and to issue fitness certificate to heavy motor vehicles after checking up their Road wortiness, fitness, age and serious action should be taken against all out dated and unworthy heavy vehicles.
e) To provide speed brakers on all the Roads before every school and busy Roads besides putting coloured Zebra crossing and traffic signals alongwith one police constable or home guard for regulating the traffic and also to construct subways, foot over bridges and walkable and clear footpaths for students and pedstrains near school and on all busy Roads.
f) To direct the respondents to frame suitable schemes for minimising prevention of accidents as per the provisions of M.V.Act, 1988 and for preserving the safety of the public on the Roads.
g) To direct the respondent No.6 to keep all the footpaths in walkable condition without any sort of obstruction and to cover all the pot holes on daily basis on all the Roads.
h) To pass such other order or orders which this Honourable Court may deem fit and proper in the circumstances of the case and in the interest of justice and public at large.

Thse petitions coming on for hearing upon perusing the petitions and the affidavits filed herein and the order of the High Court dated: 05 12-2005, 27-
12-2005, 29-12-2005, 25-01-2006, 12-06-2006, 21-08-2006 & 11-09-2006 made in WP. No. 20228 of 2005 and dated: 16-03-2006, 17-7-2006 made herein and upon hearing the arguments of the above-mentioned counsels, the Court made the following ORDER:
β€œIn furtherance of the directions given by the court on 27-12-2005 and thereafter for removal of encroachments from pavements and footpaths throughout the twin cities of Hyderabad and Secunderabad, number of steps have been taken by the Municipal Corporation, Hyderabad, for re-location of the booksellers of Kothi area, hawkers and those who have been issued identity cards.
Although learned Counsel representing the booksellers of Kothi, who have unauthorisedly encroached the public property, made grievance that the area of cubicles allotted to their clients is not equivalent to the one offered in the first instance, but after going through order dated 10-10-2006 passed by the Additional Commissioner (Estates), Municipal Corporation, Hyderabad, we are convinced that the grievance made by the booksellers of Kothi area is not substantial and calls for no further direction by the court. In our considered view, the booksellers, who were unauthorisedly occupying the public premises and even roads do not have the locus to question the allotment of sites measuring 26-80 squares feet and 29-90 square feet and more so because, this reduction in the area allotted to the hawkers has been necessitated for allotting sites to maximum numbers of booksellers, who are to be shifted from Kothi area.
Learned counsel representing the booksellers then made grievance that some of them have not been allotted sites. To redress this grievance, we asked Shri K.Dhananjaya Reddy, Additional Commissioner (Planning), Municipal Corporation, Hyderabad who is present in person, to hear the grievances of the aggrieved booksellers and remedy the same. Shri Reddy gave out that the booksellers can contact him in his office between 3 p.m. and 5 p.m. on October, 13 an 14, 2006. This, in our opinion, is sufficient to redress the grievance of the booksellers.
With a view to ensure that the booksellers of Kothi area do not continue with their unauthorized occupation of the public property, we direct that within three weeks counted from 14-10-2006, all the booksellers of Kothi area shall positively shift their establishments to the new sites. If they fail to do so by November 4, 2006, the authorities of Municipal Corporation, Hyderabad, shall not only be entitled to resort to all legally permissible modes and if necessary, force for evicting the booksellers from Kothi area. Commissioner of Police, Hyderabad, is directed to provide necessary police assistance to the authorities of Municipal Corporation, Hyderabad, for removing the structures of booksellers, who fail to vacate Kothi area by November 4, 2006. It will also be open to the authorities of Municipal Corporation, Hyderabad, to register criminal cases against those who resist removal of encroachments from Kothi area.
Insofar as the shopkeepers to whom identity cards have been issued are concerned, necessary facilities may be provided to them for shifting to the new sites within a period of one month from today.
The hawkers to who permissions have been granted for undertaking the acitivity in the identified hawking zone must also shift to the said hawking zone on or before November 4, 2006.
Insofar as other footpath and pavement vendors whose applications for allotment of sites or issue of identity cards have been rejected by the concerned authority of Municipal Corporation, Hyderabad, we deem it proper to impress upon learned Special Government Pleader to convene a meeting of the authorities of Municipal Administration Department, Government of Andhra Pradesh; Municipal Corporation, Hyderabad; Hyderabad Urban Development Authority and traffic police in an attempt to find out an amicable solution to the problem. The authorities concerned should try to identify some other site, which can be declared as fresh hawking zone where these persons may shift their acitivities. A report based on the deliberations made by the committee be produced before the court on the next date of hearing, which is fixed as 13th November, 2006.
While adjourning the case, we deem it proper to take cognizance of the statement made by Shri V.T.M.Prasad, learned counsel for Andhra Pradesh State Road Transport Corporation that medical examination of the remaining 300-400 drivers shall be completed before 13th November, 2006. Copy of Circular No. PD/13/2005 dated 30-03-2005, which provides for periodical medical examination of the drivers is taken on record.
List the case on 13th November, 2006 for futher consideration.”
