The petitioner in the present writ petition has come up before us with a prayer to issue a writ of mandamus commanding the respondents to provide one security guard (Shadow) at his own expenses.
Learned counsel for the petitioner submitted that petitioner is a business man and has persistent threat of his life and liberty. Looking to the persistent of threat of life, he was earlier provided security cover on his own expenses at Meerut for one month and later on the same was extended on same terms.
Learned counsel for the petitioner further submitted that petitioner shifted from Meerut to Ghaziabad, the security cover provided to the petitioner was withdrawn by the S.S.P., Meerut. Thereafter he moved an application dated 15.2.2018 (Annexure-6 to the writ petition) before the Senior Superintendent of Police/District Magistrate, Ghaziabad for providing security cover at his own expenses, but till date no action has been taken thereon.
As far as request to provide security cover is concerned, suffice it to mention here that as threat perception has been complained with regard to the petitioner, we proceed to mention that it is always open for the petitioner to move an application as per the Government Order dated 9.5.2014 that deals with providing of security guard, as such, in case, such an application is moved by the petitioner, it is always expected that the District Level Security Committee, headed by the District Magistrate will consider the said application, in accordance with law.
We dispose of the matter directing the respondent No.2-District Magistrate, Ghaziabad to place the matter before the District Level Security Committee, which will decide the matter afresh after considering the threat perception of life and liberty of petitioner, within four weeks.
With the aforesaid observation/direction, the writ petition stands finally disposed of.
