Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that the applicant was falsely implicated along with the other co-accused merely showing the recovery of golden articles There is no criminal history. The prayer of bail of co-accused Mohamad Sharik has been allowed on 28.4.2010 in Criminal Misc. Application No.7817 of 2010. However, the applicant is in jail since 6.3.2010.
In view of the above, without expressing opinion on merit, let the applicant Waseem alias Bhanja be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned in Case Crime No. 720 of 2009 under Section 395/397/412 & 120B I.P.C. PS. Hayatnagar District Moradabad.
