Heard learned counsel for the petitioner.
This writ petition has been filed seeking a direction to the concerned court to decide pending application under Order 9 Rule 13 read with Section 151 CPC in Misc. Case No. 24/74 of 2016 (Ziyauddin Vs. Waqf Babu Avaz Ali) in S.C.C. Suit No. 62 of 2014 (Waqf Babu Avaz Ali Vs. Ziyauddin) if possible within two months. A further prayer to decide Misc. Case No. 24/74 of 2016 (Ziyauddin Vs. Waqf Babu Avaz Ali) pending in the court of Judge, Small Causes Court, Kanpur Nagar within a stipulated time has also been made.
Considering the facts and circumstances of this case, without expressing any opinion on the merits of the case, the concerned court is directed to decide the aforesaid case, as expeditiously as possible, in accordance with law, preferably within six months, without granting any unnecessary adjournments and giving short dates provided there is no other legal impediment considering the provisions of the relevant Acts that may be applicable in this case including any other provisions that are required to be considered while disposing of the case.
With the aforesaid observations, present writ petition stands disposed of.
