1. This application has been filed by the applicant (original petitioner) with the prayer to restore Special Civil Application No.824 of 2012 to its original status on file. The said petition was dismissed for non prosecution by order dated 28-3-2012 of this Court.
2. Heard Ms.Stuti Jani, learned advocate for Mr.Dharmesh V.Shah for the applicant and perused the averments made in the application.
3. For reasons stated in paragraphs Nos.2 and 3 of the application, the prayers made by the applicant deserve to be granted.
4. Accordingly, the following order is passed:
Order dated 28-3-2012 passed in Special Civil Application No.824 of 2012 is recalled. The said petition is directed to be restored to its original status on file.
5. The application is disposed of, in the above terms.
