Heard Sri Shivajee Singh Sisodiya, learned counsel for the petitioner, Sri H.M.B Sinha, learned counsel for respondent nos. 4 to 6 and the learned standing counsel.
This writ petition is preferred against the orders dated 31.7.2017 & 28.8.2017, disposing of issues nos. 1 to 3, in favour of plaintiff - respondent nos. 4 to 6.
During pendency of the writ petition, a compromise dated 6.2.2018 is said to have taken place between the parties.
Learned counsel for the parties jointly submit that in view of above compromise, proceedings instituted by private respondents nos. 4 to 6 are liable to be decided in terms of compromise, but after due verification.
This writ petition is disposed of, with the consent of learned counsel for the parties, with the following directions:
(1) Parties shall appear before respondent no.3 / Sub- Divisional Officer, Sadar, Bareilly on 4.4.2018 in Case No.25/2015-16, under Section 229-B of the U.P. Z.A & L.R Act, along with a certified copy of this order as well as the original compromise, which shall be taken on record without any objection.
(2) Learned counsel for the petitioner shall ensure the presence of proforma respondent nos. 7 to 18 before the authority on the date fixed.
(3) The respondent no. 3 shall decide the proceedings, in terms of the compromise, but after due verification.
