Heard learned counsel for the parties.
Counter and rejoinder affidavits have been exchanged.
By means of this transfer application, the applicant wife seeks transfer of a divorce petition filed by the husband at Lalitpur. Transfer of this case is sought to district Jalaun at Orai on the ground of convenience and also on the ground of pendency of cases under the Domestic Violence Act, a criminal complaint under Section 498-A, 323, 504, 506 and 3/4 D.P. Act, as also an Execution Case under Section 128 Cr.P.C. for recovery of maintenance awarded, at Jalaun at Orai between the parties.
In the Counter affidavit filed, pendency of aforesaid three cases at Orai, is not disputed.
In the considered opinion of this Court all cases between the parties should be decided at one place which would be convenient for all concerned. For the reason alone, this transfer application is liable to be and is hereby allowed.
Case No. 1 of 2018:Arshad Ali vs. Wajahat Fatima, pending before the Principal Judge, Family Court, Lalitpur shall stand transferred to District Jalaun at Orai, forthwith.
