Heard learned counsel for the petitioner.
This writ petition has been filed for a direction to the learned Civil Judge (Junior Division), Shahganj, Jaunpur to decide the 6C application as well as the Original Suit No. 94 of 2012 within a stipulated time.
Since the 6C application has not been decided in the aforesaid suit, the petitioner has confined his relief for deciding the 6C application in a time bound manner.
Considering the facts of the case and prayer made by the learned counsel for the petitioner, the Civil Judge (Junior Division), Shahganj, Jaunpur is directed to decide the 6C application expeditiously, preferably within a period of six months from the date of production of certified copy of this order, without granting any unnecessary adjournment to either of the parties.
After decision on 6C application, if the suit itself is not decided within a reasonable time, liberty is granted to the petitioner to approach this Court for a direction to the Court below to decide the suit.
With the aforesaid observation/direction the present writ petition is disposed of.
