HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.26110 of 2014 ORDER :
The case of the petitioner is that he owns land in Survey Nos.255/1B and 256/2A2 of Bodduvaripalem Village, Kodavaluru Mandal, SPSR Nellore District. For expansion of the National Highway No.5, an extent of 284 square meters in Survey No.256/2A2 and 1,092 square meters in Survey No.255/1B was acquired and compensation to the extent of said acquisition was paid to the petitioner. The petitioner avers that recently plans were drawn up for construction of bus-bay in the said locality. The grievance of the petitioner is that the plan shows that more extent of land than acquired from him is proposed to be utilised for construction of bus-bay, which is illegal.
Alleging the same, the petitioner submitted a representation, dated 09.04.2014, to the Revenue Divisional Officer, Kavali, a copy of which was also marked to the Project Director, National Highway Authority of India, SPSR Nellore District.
Learned counsel for the petitioner submitted that so far, no orders are passed on the representation submitted by the petitioner and on the contrary, active steps are being taken to utilise the land of the petitioner in excess of the land acquired.
Having regard to the submission of the learned counsel for the petitioner, without expressing any opinion on merits of the case, respondent Nos.3 and 5 are directed to verify the genuineness of the claim made by the petitioner vis-à-vis the acquisition of land and utilisation of the same for the purpose of construction of bus-bay, consider the same and pass appropriate orders as warranted by law within a period of three weeks from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of.
There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
