THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 6447 of 2008 ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) No writ of Mandamus can be issued in this matter, as the appointment of the 4th respondent is questioned.
Though the learned counsel for the 4th respondent appears and submits that the 4th respondent has not applied for the post in question, learned counsel for the petitioners submits that the 4th respondent has applied for the post and he admits that no appointment has been made as yet.
We are of the view that it is a premature action and therefore we dismiss the writ petition. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
