The writ petition has been filed seeking a writ of mandamus to direct the first respondent to accept the declaration regarding printing the monthly Tamil Magazine, namely, "IDIMURASU" at Chennai.
2. Heard petitioner (party-in-person) and the learned Additional Government Pleader.
3. The petitioner wanting to publish a monthly Magazine called "Idimurasu", approached the authority concerned on 04.08.2008 and made a representation. The petitioner states that the Tahsildar Enquiry was conducted and thereafter Police enquiry was also conducted. The petitioner states that he has approval for the name "Idimurasu". Thereafter, he sought permission of the first respondent, The District Revenue Officer, to publish the monthly magazine, which was rejected by proceedings dated 13.07.2009 in Pa.Mu.No.33434/08(c5). In the said order of the District Revenue Officer, the petitioner is given the remedy of appeal before the Press & Registration Appellate Board. The petitioner as stated has filed an appeal before the Press & Registration Appellate Board on 03.08.2009. It is stated in the affidavit in ground No.2 that the appeal filed by petitioner is still pending. Since the petitioner has opted for the alternative remedy by way of appeal before the Press & Registration Appellate Board and the same has not been disposed of on merits, the Press & Registration Appellate Board is directed to dispose of the appeal at an early date, preferably within three months from the date of receipt of a copy of the order. The petitioner is entitled to seek further relief in accordance with law, if aggrieved by the order of the Board.
4. In the result, the writ petition is disposed of with the above directions. No costs.
