V.Sundaram vs The District Manager

Madras High Court|19 September, 2017

JUDGMENT / ORDER

Heard Mr.S.Balasubramanian, learned counsel for the petitioner and Mr.Arumugha Rajan, learned counsel accepting notice for respondents 1 to 3 and Mrs.A.Sri Jeyanthi, learned Special Government Pleader accepting notice for the fourth respondent.
2. The petitioner seeks a blanket direction upon the respondents not to locate any TASMAC shops in the locality namely Alapakkam Main Road, Maduravoyal.
3. The case of the petitioner is that he has been granted license to sell eatables and collect empty bottles in the TASMAC retail vending shop bearing shop No.8708. Now, the petitioner's apprehension is that the respondent Corporation will locate new shops in and around the same area. Therefore, the petitioner wants the respondent Corporation to be prohibited from doing so.
4. The relief sought for by the petitioner is thoroughly misconceived. As long as the petitioner is possessing a valid licence, he can continue to sell eatables and collect empty bottles in the TASMAC shop concerned and the petitioner cannot seek a blanket direction with regard to a policy decision that may be taken by the respondent Corporation. I am of the considered view that no relief can be granted to the petitioner.
5. Accordingly, the writ petition is dismissed. No costs. Consequently, the above WMP is also dismissed.
